Role/Legal Authority of DAS

The Department of Administrative Services (DAS) provides human resource advice on matters directly pertaining to DAS's authority—authority that exists under Iowa Code chapters 8A and 70A, for example, and then authority that exists by virtue of its collective bargaining obligations under Iowa Code chapter 20.
However, when employment issues raise litigation concerns—especially litigation concerns that are not directly connected to DAS's authority under chapters 8A, 70A, or 20—then input is generally obtained from the hiring authority's legal representatives . . . as, in the event of litigation, it will be the legal representatives that defend the hiring authority's actions, not DAS.
